CHAPTER: 12

Export Houses/ Trading Houses/ Star Trading Houses/ Super Star Trading Houses

12.1 Policy

The policy relating to the status holder is given in chapter 12 of the Policy.

12.2 Application for Grant/ Renewal Of Status
  1. For grant/renewal of any status, the application shall be filed latest by 30th November. Deficiency, if any, must be communicated by the licensing authorities by 15th December. If this is not done, then existence of deficiency and non rectification thereof 31st December will not be treated as a ground for rejecting the application. The applicant shall be required to rectify the deficiency to the licensing authorities by 31st December. Any application, where deficiencies are rectified thereafter, shall be rejected outrightly. However, there shall not be any last date for filing of application by manufacturing companies or industrial houses or domestic service providers as given in paragraph 12.12 (A) of the Policy. The application for Export House, Trading House, Star Trading House and Super Star Trading House shall be filed in Appendix-19. The application for Service Export House, International Service Export House, International Star Service Export House International Super Star Service Export House status shall be filed in Appendix-19B. Manufacturing companies or Industrial houses or service providers shall file application in Appendix- 19A.
  2. Application for grant of certificate for Export House/Trading House/Service Export House, shall be filed with the concerned regional licensing authority headed by Jt.DGFT. However application for grant of certificate for Star Trading House, Super Star Trading House, International Service Export House, International Star Service Export House, International Super Star Service Export House and Golden status shall be filed with the Director General of Foreign Trade.
  3. Such application shall be made by the registered office in the case of a company and head office in case of others.
  4. Such application shall be accompanied by a certificate from C.A certifying that 95% of the foreign exchange proceeds have been realised in respect of exports / services rendered by the applicant in the preceding three licensing years/preceding year (excluding the exports made during the last six months from the date of filing of the application).
12.3 Deleted

12.4 Maintenance of Accounts

The certificate holder shall maintain true and proper accounts of its exports and imports based on which such recognition has been granted and the exports and imports made during the validity period of such recognition certificate. The record shall be maintained for a minimum period of three years from the expiry of the validity of such certificate. These accounts shall be made available for inspection to the licensing authority or any authority nominated by the Director General of Foreign Trade.

12.5 Refusal/ Suspension/ Cancellation of Certificate

The recognition certificate may be refused or suspended or cancelled by the authority which is competent to issue/renew such certificate, if the certificate holder/ applicant or any agent or employee acting on his behalf:
  1. fails to discharge the export obligation imposed;
  2. tampers with licences;
  3. misrepresents or has been a party to any corrupt or fraudulent practice in obtaining any licence;
  4. commits a breach of the Foreign Trade (Development and Regulation) Act, 1992, or the Rules and Orders made thereunder; or
  5. fails to furnish the information required by the Director General of Foreign Trade or any person or authority authorised by him.
A reasonable opportunity shall be given to the applicant or the certificate holder before taking any action under this paragraph.

12.6 Appeal

An applicant who is not satisfied with the decision taken to suspend or cancel the certificate, may file an appeal to the Export House Committee in the Directorate General of Foreign Trade within 45 days of the date of the said decision. The decision of the Committee shall be final.

The status holders shall be eligible for Cars in terms of paragraph 12.10 of the Handbook (Vol.1) (RE-99), 1997-2002, shall be entitled for the same as per condition laid down in the aforementioned paragraph

12.15 Application for Golden Status

The exporter eligible for Golden status certificate, in terms of paragraph 12.14 of the Policy, shall submit a simple request enclosing the self attested photocopies of previous three certificates and a CA certificate indicating the FOB value of exports in the preceding year. They will be required to surrender current and valid recognition certificate, if any, held by them on date. Such applications shall be filed with the Directorate General of Foreign Trade.
